Could we legally be allowed to terminate his contract? (ok we lose 40m in transfer fee, but lets be honest we wont get anywhere near that in jan anyway, but I suppose save £5m or so until then in wages?)

Could we refuse to pay him for a certain amount of time for breach of contract or just fine him?

Not yet but Mancini explained that he took Dzeko off for de Jong to try to settle the midfield but with the intention of bringing Tevez on after about 5 minutes later. Then Tevez refused to enter the pitch.
