Only got it in Spanish at the moment, I don'y think it's decided whether it is suspended or not.

But they 'habitually do', although there have been cases where they dont suspebd it, it says

Habitualmente, los jueces deciden suspender la entrada en prisión para los condenados cuando las penas no superan los dos años y no tienen antecedentes penales. Aún así, ha habido casos en los que los magistrados sí han decretado la entrada en la cárcel. Uno de ellos, por ejemplo, se produjo cuando la Audiencia Provincial de Malaga acordó que Isabel Pantoja, sentenciada a dos años, ingresara en un centro penitenciario.

It is usually the case that judges will decide to suspend the imprisonment of those found guilty when the sentence does not exceed two years and when the guilty party has no prior convictions. Even so, there have been cases in which the magistrates have indeed decreed that the guilty party should be incarcerated. One such case, for instance, was when the Malaga Provincial Hearing came to the conclusion that Isabel Pantoja, sentenced to two years, should be sent to a correctional facility.

Turns out a prison term of under two years can be suspended according to Spanish law. Be interesting to see whether randomers who didn't pay their tax had sentences of over two years and thus went to jail.

Hope he decides he now doesn't like Spain and wants to reunite with Pep.

There's an outside chance though mate - dont forget the whole Madrid-Barcelona/Catalan thing which has come up before with this sort of thing. I wouldn't put it past them when the jueces are in Madrid!

True, but the ruling class won't want to make too much of a scene about financial crime! The Calle de Serrano crowd are crooked as fuck.
