I can honestly say right now I hate the Argie fucker! I never want to see him in a City shirt again and if our oil rich owners have any sense we'll ditch the cunt and right off £30M. The impact to the PL, CL and overview morale if we bring him into the squad is too much of a risk.

Can you guys do a poll to gauge MCF.net perspective? I wonder sometimes if I'm being irrational.

Just read through the thread mate.. if you are being irrational then so is everyone else and his dog.

The bottom line is that it is Mancini's shout as to what happens in regards the team. The club will get rid of him as and when they want to for a figure they deem ok, so far 40 mil has been suggested.

Unless Fatso crawled on his knees I can't see Bob even talking to him so.. that's about that really.

If he goes ahead and tries to sue, City should close ranks and fuck him about till the end of his contract to teach the insanely dumbshit a lesson, but he won't go near trying to sue so they will just get shut as soon as they can.

Sadly we can't ditch him because he's under contract - the internal inquiry was undertaken to see if there was any evidence of gross misconduct (which would have enabled us to effectively rip his contract up without penalty to us) sadly there was only enough evidence to show a lesser charge of misconduct which only enables us to give him a lesser punishment (suspension, fine, plus written warning). The club has to be careful to do everything 'by the book' if they dont want to be sued by the player, thanks to today's compensation culture.

MANCHESTER CITY say they are prepared to sue Carlos Tevez for up to £10million.
The Argentina striker wants to take legal action against manager Roberto Mancini for defamation of character over the Italian's claim Tevez refused to come on as sub at Bayern Munich last month.

But Tevez, 27, is set to face a solicitor's letter himself, with City determined to go to war with their former captain.

Tevez's former club Corinthians offered to buy him for £40m in the summer — a deal that did not go through in the end because the Brazilian club could not come up with the money.

City see that offer as the benchmark for his true valuation.

Unfortunately, Tevez's antics and lack of football mean City would be highly unlikely to get an offer greater than £30m.

City are ready to sue Tevez for the shortfall, which the club claims is completely the player's fault.

In fact, Corinthians now value the player at far less than that — but reckon they are on the verge of capturing the troubled star.

Corinthians president Andres Sanchez said: "Today, his value is £16m because he is facing so many problems at Man City. Although many people don't believe it, I can assure you that Tevez is about to sign with Corinthians. Our fans can't imagine how close Tevez is."

However, sporting director Edu admits any deal relies on whether Tevez fancies a return to Brazil.

The ex-Arsenal midfielder said: "We are still thinking about Tevez but we have to wait and see if there are the right conditions.

"We expect to know what City will decide but what is the will of the player? If he wants to return to Argentina or remain in Europe, it is useless for us to present an offer."

City's hierarchy had already discussed the idea of suing Tevez before Tuesday's announcement that they were fining him a further four weeks' wages, totalling £800,000.

They wanted to wait until their internal inquiry into Tevez's behaviour had been completed before investigating legal action.

City's chairman Khaldoon Al Mubarak has told Mancini he will cover all his legal fees in a defence of defamation against Tevez.

The club and manager find this latest threat from Tevez his most ludicrous move in the whole tawdry saga.

The player is already being made to train with the reserves. If he does seek a move that is less than the club's valuation he will have to pay for it.

This is the precedent set in the Mutu case, and one that the other players in the squad would do well to learn: a player is legally obliged to 'reasonably' maintain his value.

Read this a bit ago that if true, would send me over the top in rage with the Tevez cunt:

The Premier League leaders suspect Tevez's actions may have been premeditated after he had been told six days before the Bayern game that his requests to leave the club had cost him £6m in loyalty bonuses due over the course of his contract.


If his stunt was about moaning over money when he has so much, I say we go on and sue him for everything that he has left because he doesn't deserve shit

This was why I thought him suing was a bad idea(for him) when he gets a ruling against himself, it sets the groundwork for a shortfall counter claim.

What might Mancini’s defence be?
Strictly, it is up to the City manager to prove that his allegation was true - known as a defence of justification. That could be difficult. City have found Tévez in breach of five club rules - but crucially, regarding the confusion of the substitutes’ bench, the club could not secure firm evidence that he refused to play.
Mancini’s lawyers could instead argue that, with the eyes of football worldwide on Tévez’s behaviour, the Italian had a duty to explain to viewers what he honestly believed to be happening. They would argue that his comments are protected from libel action even if he was wrong, under a defence of 'qualified privilege’.
A court is likely to take Mancini’s side, says Razi Mireskandari, managing partner of Simons Muirhead & Burton. “He had a right to explain his honest opinion. If I was Mancini I would say, I acted reasonably in the circumstances, and I communicated what I believed was true,” he said. “And an English jury will say, Tévez, you sat on your ---- and didn’t get up.”

The Mail are saying that the Sheik has told Mancini he will personally pay all Bob's legal costs out of his own pocket if FatSoftArse tries to sue. Also speculating that Mansour is livid about Fatso and would be happy to let him disappear into the reserves for the next 2 years if needs be.

Article 15 - Terminating a contract with sporting just cause

An established professional who has, in the course of the season, appeared in fewer than ten per cent of the official matches in which his club has been involved may terminate his contract prematurely on the ground of sporting just cause. Due consideration shall be given to the player's circumstances in the appraisal of such cases.

The existence of a sporting just cause shall be established on a case by- case basis. In such a case, sporting sanctions shall not be imposed,though compensation may be payable. A professional may only terminate his contract on this basis in the 15 days following the last official match of the season of the club with which he is registered.

The club must have the numbers for how much he weighed at any point he was with us. Just weigh him every week, from the look of him he's put on a few pounds. Demand he works to get down to his fighting weight, and could probably justify not picking him until he does - so much for "sporting just cause".
