If Tevez was told not to go to Argentina by a club official (hopefully in writing) he is in breach of contract again for the same reasons quoted in the club statement about the last incident. He's already on a written warning for exactly these circumstances. It will come down to the opinion of the club's legal team. The absolute minimum will be a second written warning and the two incidents MIGHT be seen as gross misconduct together. Alternatively the legal team might say there's a case for gross misconduct from this latest incident by itself. I think we could see another inquiry.

"It's a worry to me how we can get out of this, bearing in mind that he is a human being and a top quality footballer. His actions aren't what we could possibly recommend to any other player in the game."

Manchester City striker Carlos Tevez claims he tried to contact Roberto Mancini before and after he took the decision to head back to Argentina.

The South American has returned to his homeland despite being informed by City that he was expected at training on Wednesday.

Tevez did not show for a session intended to help him rebuild his fitness following the recent row regarding his non-involvement in the UEFA Champions League clash with Bayern Munich.
City are disappointed to have seen the striker go AWOL so soon after settling that particular dispute and PFA chief executive Gordon Taylor has told Sky Sports News that Tevez risks incurring further disciplinary proceedings.

It remains to be seen what action the Premier League leaders will take, but they are refusing to waver in their stance that the forward and his advisors were not given permission he could leave the country.

Tevez, though, has hit back by claiming that he made every effort to get in touch with Mancini before he left.

He says he tried to reach the Italian coach by text and by phone over the weekend.

He also claims that he made another effort to explain himself to his boss when he arrived in Buenos Aires on Monday.

Tevez feels he is being unfairly singled out by the club just a few days after being told that he would be treated the same as any other player following the end of an internal investigation into his actions in the European clash with Bayern.

i can't understand why if players are sold during their contract, the club (buyer or seller) is required to pay their remaining wages, why arent we allowed to turn the tables on this rule and sue tevez for this amount? didn't chelsea sue mutu for his entire transfer fee? i know that was for illegal activity but a breach of contract none-the-less???

PS I will always be happy tevez scored all those important goals, but this last six months is all i will remember of him, he has overshadowed all that was good about his time at man city.

well apparently he was told by city that he would follow the same fitness regime that players such as wayne bridge and owen hargreaves as he hasnt had any game time and not match fit so that to me seems as though he was being treted the same as any other player would be so his argument is void.

Sacking might be the only way we'll get rid. He's already been available through the summer and clubs weren't exactly queueing up to sign him. Since then we've had the Munich incident and now he's gone AWOL. He's basically shitting on his own doorstep. Good footballer but who in their right mind is gonna sign him now? He may find it harder to engineer a move away in January than he thinks.

This should open the door to allow City to do exactly what they want now from the legal side.

Fatso was in the shit, now he is in the shit on his own.

Apart from getting rid of him and City being compensated surely the question is going to be how much punishment should be aimed for on behalf of the football in general.

City should as suggested sue him for his transfer value before Bayern. 40 or 50 mil.
That has got to be the only punishment that is equitable.

I see his advisors have started along the 'misunderstanding' road again now. If we haven't got this absolutely watertight this time & made sure we have proof of this directive, all the people involved in dealing with it should be sacked immediately.
