I hope I'm wrong but I don't envisage any come back on this for Tevez and Joorabchian. I lost all confidence in that when we weren't even able to get a chage of refusing to play to stick.

The odds are so heavily stacked in his favour. At best we could perhaps sue for any wages we have have paid since October (if we have been paying him) but we won't see a penny for the reduction in transfer value, loss in champs league earnings etc.

As I say, I hope I'm wrong and I'd take great pleasure in the club pulling a rabbit out of the hat and making them pay. I just don't see it.

We did actualy charge, and fine him for refusing to play, it's just that it came under the charge of misconduct & the PFA then (to their subsequent embarrassment ) backed him.

We could do all kinds of stuff to him now & they would support us. He doesn't have a leg to stand on. Why we are apparently still paying him I don't know (perhaps it's as simple as down to a ruling that we have to have a hearing before fining him/dock his wages & we can't do that if he's not here?). we may never find out the details but if we wished, we could certainly do a lot of stuff to Tevez right now. We are choosing not to for some reason.

My guess is part of the deal is we won't pursue the matter further so long as Tevez's camp doesn't make the transfer difficult by insisting on a move to a certain club and by hampering his personal negotiations to the club which a transfer has been agreed to.

Dunno about Ba in terms of a player i covet, but his buyout clause i believe is 10M not 7. That would be "affordable" to say the least given his production. I think he's in a purple patch and won't be a long term contributor to a top side.

I don't know what the situation is regarding his wages now & why the club hasn't said anything. There have been suggestions that he's still being paid, which must surely be untrue, & yet, is it ? Have they done a deal already for Jan ?

Would our business people just let him shaft us if they've reached a point where they realise we could lose more money otherwise so they cut their losses & let him stroll off smiling, getting exactly what he wants but no loyalty bonus ? Is that a 'result' for them ?

I do know something about contract and employment law...... and I would suggest that we are probably paying him unless we specifically included clauses in his contract that would address this unusual situation - which I would seriously doubt

The risk here - for either party - would be to do something that could be seen in court to be a breach of contract - CITY will not make that mistake - Tevez 'was' also acting in that manner when he returned to the UK and was 'getting on with it - he just lost the plot.

The PFA were a great help to Tevez in their ruling that basically wiped the slate clean for him - if he could just 'go through the motions' until January.

What will happen (IMO) is:

1/ We will continue to pay, until
2/ We think that the timing is right to hit him with a disciplinary and seek a massive fine - probably with the PFA on our seide this time and
3/ Look for the disciplinary to substantiate a breach of contract - again PFA support (being the legally route for action by both parties) will be important
4/ sell at a reduced fee - but hold back on all payments we can - image rights / bonuses etc
5/ sue him for loss (difference between £40/50m and the actual fee) based on the breach

If we do anything that leaves us open to a breach of contract then he can successfully sue us

I know it is a bit of "I told you so........" but a number of posters were 'clear' that I was wrong in my points above.

When asking the follow-up question along the lines of how does that work then...... McCarthy answered that all issues of disciplinaries will be sorted out / addressed at the conclusion of any deal etc - so point 2 seems to be right

Given the offers that we are receiving are at the £20m level then not only does point 4/ seem to be right but also correct would seem to my point made a little later in this thread: "....These guys are snakes - but clever ones. I agree with most of that but I think the fact that his mouthpiece has mentioned that the disciplinary stuff is still to come, could be an indication that we will go after him, when this is finished. I don't think his fucking off to Argentina was part of Kia's master plan & it could be that both sides had to come to an agreement as how to proceed in both their interests as Tevez had, in effect, gon AWOL from Kia too.

Therefore, it's possible they agreed to suspend hostilities until both sides get the deal which makes them the most money possible out of Tevez, then deal with the rest, for which Tevez, not Kia, will be liable.

2/ Same again with regard to any aspect of his contract that has lump payments etc - e.g. (FFS) Loyalty payments
and especially
3/ Full and final settlement with a legally binding agreement that CITY will not pursure either disciplnary action or claims through the courts.

Just think about it from the CITY position - the first 2 are a piss-take and the 3rd distasteful - but what would we do?? - what really could we do?? The answer lies not in our fan view of 'screw the bastard' but unfortunately most likely in an arrangement thrashed out between legal representatives of both parties - probably all through January.

I think Mancini don't really know good people skills, if we had for example Jose morihno he would keep players happy of that caliber anyways, I know that he would not loan a striker out to a team that is title contenders. Can you be more precise please? Which particular 3-4 players are you alluding to? If they are players within the squad, can you name them or are you just speculating that all is not well in the group that is currently favoured by Mancini? Are you alluding to 3-4 players that are outside Mancini's favoured group and if so, can you expand on how you think their opinion has had a detrimental affect on our season? I ask this because you offer no evidence of Mancini's poor people skills, but if you have any, it may help and add to the discussion.
We get this type of groundless speculation regularly in the media, who useit as a ploy to batter and belittle City.
