The odds are so heavily stacked in his favour. At best we could perhaps sue for any wages we have have paid since October (if we have been paying him) but we won't see a penny for the reduction in transfer value, loss in champs league earnings etc.
As I say, I hope I'm wrong and I'd take great pleasure in the club pulling a rabbit out of the hat and making them pay. I just don't see it.

We have a manager who is pissed, and rightly so, that after spending hundreds of millions we won't shell out the 20-30 required to basically win us the league with some new bodies, during an anomalous period where we have a LOT of matches, and little cover. Can't say i blame him. It's bullshit really. Now we get frugal when we're rounding turn 3 where a little turbo boost can send us down the home stretch?

i think you're bang on the money with that statement. we wouldn't need that much tbh. get demba ba for 7mil (short term). de rossi for about the same. another defender also.

I do know something about contract and employment law...... and I would suggest that we are probably paying him unless we specifically included clauses in his contract that would address this unusual situation - which I would seriously doubt
The risk here - for either party - would be to do something that could be seen in court to be a breach of contract - CITY will not make that mistake - Tevez 'was' also acting in that manner when he returned to the UK and was 'getting on with it - he just lost the plot.
The PFA were a great help to Tevez in their ruling that basically wiped the slate clean for him - if he could just 'go through the motions' until January.
What will happen (IMO) is:
1/ We will continue to pay, until
2/ We think that the timing is right to hit him with a disciplinary and seek a massive fine - probably with the PFA on our seide this time and
3/ Look for the disciplinary to substantiate a breach of contract - again PFA support (being the legally route for action by both parties) will be important
4/ sell at a reduced fee - but hold back on all payments we can - image rights / bonuses etc
5/ sue him for loss (difference between £40/50m and the actual fee) based on the breach
If we do anything that leaves us open to a breach of contract then he can successfully sue us

I think that there are only 3 outcomes possible:
1/ That he does not leave and that we bring him back to the club to be part of the squad
2/ That he does not leave and we leave hin in BA paying him £1m a month
3/ We reach some arrangement that sees him leave
Strangely, the first would be best commercially - but can anyone now see this happening?
The 2nd solves nothing and only delays number 1 or 3 happening in the summer - how would our hand have strengthened?
So the 3rd is most likely but this brings me back to the strength of the Kia hand - no matter how much we fucking hate it
