Completely right of course but I'd go so far as to say what if it was Otamendi or MDM?

If it was Mario, the pundits would all be calling for criminal charges saying, "As a top-level striker you know where the defender is and to strike him with your elbow like that must be intentional." Case closed, lock him away and throw away the key.
