Fraud is obviously illegal. But you can allege fraudulent conduct in a civil court, if you like.
Standard of proof will be as agreed in PL rules for arbitration - probably 'the balance of probabilities' rather than the criminal standard of 'beyond reasonable doubt'. Much easier to meet. Like how Trump is a rapist according to the civil courts but he's not in prison.
