Its a no win situation now. We don't need him in the team and will have to sell him for less than market value in Jan.

He has shafted us since last season ended and he appeared on tv saying he wasn't coming back. We've been paying his wages since then, and he has just been sat on his arse ever since and will do until he leaves. Need to get moving on shifting him on Jan 1st so he costs us less in wages. In my eyes he should pay us back 6 months of his salary as it seems he never had any intention himself of playing for us again.

We never had the chance to - if we could have proved GROSS misconduct then we could have sacked him and taken legal action - gross misconduct would have been proof that he refused to play - all we could do was prove the lesser charge of misconduct (which was proof that he refused to warm up).

We all know what the little fucker was doing that night, but it shows how difficult it can be to establish intent.

And this really explains why he won't contest the matter, last thing he wants is an oversight ruling that places blame at his feet. I think in getting it knocked down from gross misconduct he has insulated himself from being sued. If I was Tevez right now, I'd apologise. It'd put everything back on Mancini to keep his word and probably even protect his 'loyalty' payment should he move on in January, which no matter what happens is still the most likely scenario.

Carlos Tevez faces a new disciplinary charge from Manchester City after defying Roberto Mancini again and flying home to Argentina without permission.
Tevez has chosen not to dispute his punishment for allegedly refusing to play against Bayern Munich in September and looks set to be fined a further two weeks' wages unless he turns up for training at 10.30 on Wednesday morning.
That looks unlikely, as our pictures show him arriving in Buenos Aires on Tuesday.

Sportsmail can reveal that Tevez's representatives asked City's temporary chief executive John McBeath at the weekend if the 27-year-old could spend a week in Argentina but the request was denied as manager Mancini wanted him to continue working on his fitness.
Tevez then asked Mancini's assistant Fausto Salsano on Monday and was again turned down after the second request had been relayed to the City manager.
However, it appears Tevez ignored these instructions and flew to South America anyway. On arriving at Buenos Aires airport with his daughter Florencia, Tevez said only: 'I am here to get some rest.'
The striker was on a day off on Tuesday anyway so had not breached his contract. But unless the former club captain turns up at Carrington on Wednesday morning he will once again find himself facing a misconduct charge.
In order for him to be back in Manchester on Wednesday, Tevez will have had only a matter of hours on the ground in South America.
He has been training on his own at Carrington for the last month as City's fitness staff endeavour to get him in shape.

However, it can also be revealed that Tevez has missed at least some of that training in recent weeks with mystery injuries.
On two occasions, he has not trained because of non-football related injuries and as a result Mancini's staff believe he has made relatively poor progress as they try to get him in a condition in which he could theoretically play a competitive game.
A City spokesman said: 'Carlos is part way through a training plan and is due to resume on Wednesday following a rest day.'
If, as expected, Tevez doesn't show up City will treat him as they would any other player who disobeyed direct instructions. He can expect to be fined two weeks' wages, in accordance with PFA guidelines.
His camp have declined to comment.

Can we not fine him 2 weeks wages for each day he fails to turn up, then fire him for not making a significant effort to get fit & fulfil his contract, then sue him for the loss of his value in the transfer market ?

This seems like a Tevez inspired move & probably has Kia once again choking on his kebab. I recon he will try to claim that Tevez has been given verbal permission, so I hope we put it in writing that he has broken the rules & that we want him back here training NOW or he will face legal action.
