We never had the chance to - if we could have proved GROSS misconduct then we could have sacked him and taken legal action - gross misconduct would have been proof that he refused to play - all we could do was prove the lesser charge of misconduct (which was proof that he refused to warm up).
We all know what the little fucker was doing that night, but it shows how difficult it can be to establish intent.

This seems like a Tevez inspired move & probably has Kia once again choking on his kebab. I recon he will try to claim that Tevez has been given verbal permission, so I hope we put it in writing that he has broken the rules & that we want him back here training NOW or he will face legal action.
